Terms of Service

Effective October 29, 2026

These terms are an agreement between you and Kaizen Grow (“Kaizen Grow”, “Kaizen”, “we”, “us”) for using the Kaizen iPhone app and website (together, “Kaizen”). By using Kaizen, or by checking the box to accept these terms, you agree to them and to our Privacy Policy. If you don’t agree, don’t use Kaizen.

1. Who can use Kaizen

You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. Your content and your data

What you write in Kaizen (goals, plans, journal entries and so on) belongs to you. Kaizen stores it on your iPhone; we don’t receive a copy. Because your data lives on your device, you are responsible for keeping your iPhone and its backups safe. Kaizen keeps automatic backup copies on your iPhone and lets you export a file at any time (Me → Export my data), but if your iPhone is lost, reset or replaced without a backup, we can’t recover your data for you.

If online accounts launch later, they will be optional and you will be asked to agree to any new terms that apply to them first.

3. Using Kaizen properly

Don’t use Kaizen to break the law, interfere with it, reverse engineer or copy it (except where the law allows), resell it, or harm anyone. We may suspend or end access to features that we control for anyone who does.

4. Not medical or professional advice

Kaizen helps you build habits. Its content, quotes, suggestions, streaks and tree are general information and motivation, not medical, mental-health, fitness, nutrition, legal or financial advice. Talk to a qualified professional before making changes to your health, training or finances. Kaizen is not designed for emergencies. If you are in crisis or in danger, contact your local emergency number (911 in the US) or a crisis line (988 in the US).

5. Subscriptions and purchases

Kaizen is free to use today. Some features may later require a paid subscription bought through Apple’s App Store. Before you buy, the App Store shows the price, the length of each period and any free trial. Payment is charged to your Apple ID at confirmation. Subscriptions renew automatically at the same price for the same period unless you turn off auto-renew at least 24 hours before the current period ends; your Apple ID is charged within 24 hours before each renewal. You can manage or cancel at any time in iPhone Settings → [your name] → Subscriptions. Cancelling stops the next renewal and you keep access until the paid period ends. If you cancel during a free trial, you won’t be charged; any unused part of a free trial ends when you buy a subscription. Refunds are handled by Apple under Apple’s policies. If a price changes, Apple will tell you in advance and, where required, ask you to agree.

6. Availability and changes

We work to keep Kaizen running well, but we don’t promise that it will always be available, error-free, or that data can never be lost. We may change, add or remove features. If we stop offering a feature you paid for, we’ll give reasonable notice.

7. Ending

You can stop using Kaizen and delete your data at any time (Me → Delete my data, or delete the app). We may end these terms or your access to features we control if you seriously or repeatedly break them, or if we stop offering Kaizen. Sections 2, 4, 8, 9, 10, 11, 13 and 14 keep applying after that.

8. Disclaimer

To the fullest extent the law allows, Kaizen is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

9. Limitation of liability

To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill; and (b) our total liability for all claims relating to Kaizen is limited to the greater of the amount you paid for Kaizen in the 12 months before the claim arose, or US $50. Some places don’t allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer that cannot be waived.

10. Indemnity

If you use Kaizen in breach of these terms or the law and that causes a claim against us, you agree to cover our reasonable costs from that claim, to the extent the law allows. This doesn’t apply to consumers where the law doesn’t allow it.

11. Law and disputes

Please email hello@kaizengrow.app first; most problems can be fixed quickly, and we’ll try in good faith for 30 days before either of us goes further. These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Pennsylvania, unless the law where you live gives you the right to bring a claim in your local courts. Either of us may bring a qualifying claim in small-claims court.

12. Apple App Store

If you got Kaizen from the App Store: these terms are between you and us, not Apple. Apple is not responsible for Kaizen or its content. Your licence is to use Kaizen on Apple devices you own or control, as allowed by the App Store’s Usage Rules. Apple has no obligation to provide maintenance or support for Kaizen. If Kaizen fails to meet a warranty that applies, you can tell Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for any claims about Kaizen, including product liability claims, claims that Kaizen fails to meet a legal or regulatory requirement, consumer-protection or privacy claims, or claims that Kaizen infringes someone’s intellectual property; we, not Apple, are responsible for investigating and handling those claims to the extent these terms make us responsible. You confirm that you are not in a country under a US government embargo or designated as supporting terrorism, and not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Feedback

If you send us ideas or suggestions, we may use them without owing you anything.

14. General

These terms and the Privacy Policy are the whole agreement between you and us about Kaizen. If a court finds part of them unenforceable, the rest still applies. If we don’t enforce a part right away, we haven’t given up the right to. You may not transfer these terms without our consent; we may transfer them if Kaizen is transferred to someone else who keeps them in place. You agree we can contact you electronically (in the app or by email) about Kaizen.

15. Changes to these terms

We may update these terms. We’ll change the date above and tell you in the app before material changes apply. If you keep using Kaizen after that, the new terms apply.
